Fearless Fund, a prominent venture capital firm known for championing Black women entrepreneurs, is standing firm in its commitment to the Striver’s Grant program despite facing legal obstacles. On June 3, 2024, the Eleventh Circuit Court of Appeals upheld an injunction that temporarily suspends the program, citing concerns of racial discrimination.

The injunction stems from a lawsuit by the American Alliance for Equal Rights, which argues that Fearless Fund’s practice of exclusively supporting Black businesswomen violates the Civil Rights Act of 1866. This post-slavery legislation was originally crafted to ensure economic freedom and equality for newly freed enslaved people.

In a poignant response to the court’s decision, Arian Simone, co-founder of Fearless Fund, expressed her concerns during a televised interview with CNN’s Abby Phillip. Simone highlighted the ironic twist of using a law meant to protect minorities as a weapon against them. She emphasized the need for immediate action from political leaders to support diversity, equity, and inclusion (DEI) initiatives.

“Now more than ever, it is critical for our elected officials to make a definitive stand for DEI,” Simone urged, calling for an executive order from the President to safeguard funding opportunities for marginalized communities.

Since its inception, Fearless Fund has been at the forefront of closing the significant funding gap faced by Black women in the venture capital sector. Co-founders Arian Simone and Ayana Parsons have successfully allocated over $26 million in grants, aiding more than 40 businesses. This substantial support highlights the ongoing disparity in venture funding, with Black women receiving less than one percent of all venture capital.

Despite the legal challenge, Fearless Fund remains resolute. The firm’s legal team is diligently exploring all possible avenues to overturn the injunction and continue their mission. “This is not the end but the beginning of a renewed fight,” the firm stated confidently on June 4.
